Acceptance of Terms

By accessing and using the DriveSmarter website ("the Tool"), you accept and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Tool.

Nature of the Tool

DriveSmarter is a free, educational car cost comparison calculator. It is designed to help users explore and understand the potential costs associated with vehicle ownership in New Zealand. It is NOT a financial advisory service.

The Tool provides estimates and projections based on:

  • User-provided inputs (vehicle prices, driving habits, fuel costs, etc.)
  • Standard financial formulas (amortisation, compound interest, diminishing value depreciation)
  • Generalised assumptions that may not reflect your specific circumstances

No Financial Advice

Nothing on this website constitutes financial advice, investment advice, tax advice, legal advice, or any other form of professional advice. Specifically:

  • We do not recommend any particular vehicle, lender, insurance provider, or financial product
  • We do not guarantee the accuracy, completeness, or timeliness of any calculations or information
  • We do not take into account your personal financial situation, objectives, or needs
  • We are not registered as a financial adviser under the Financial Markets Conduct Act 2013 (NZ) or any equivalent legislation

Accuracy of Calculations

While we strive to use correct mathematical formulas and reasonable default values, the results produced by the Tool are estimates only. Actual costs may differ significantly due to:

  • Fluctuations in fuel and electricity prices
  • Changes in interest rates or loan terms offered by lenders
  • Variations in insurance premiums based on individual risk profiles
  • Unexpected maintenance, repairs, or accident costs
  • Actual depreciation rates that differ from the generalised model used
  • Changes in government policy, incentives, taxes, or levies
  • Individual driving patterns, vehicle condition, and usage

We make no warranty or representation that the results will match actual real-world costs.

Limitation of Liability

To the maximum extent permitted by law, DriveSmarter and its creators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of, or reliance on, the Tool or its results
  • Any decisions made based on information provided by the Tool
  • Any errors, inaccuracies, or omissions in the calculations
  • Any loss or damage of any kind incurred as a result of using the Tool

You use the Tool entirely at your own risk.

User Responsibilities

As a user of DriveSmarter, you are responsible for:

  • Entering accurate and realistic input values
  • Understanding that results are estimates, not guarantees
  • Seeking professional advice before making financial decisions
  • Verifying all information independently through appropriate channels (lenders, insurers, dealers, NZTA, etc.)
  • Using the Tool lawfully and in accordance with these terms

Usage Limits & Google Sign-In

DriveSmarter offers 3 free comparisons per day without requiring an account. To access unlimited comparisons, you may sign in using your Google account.

When you sign in with Google:

  • We receive your display name, email address, and profile picture from Google's authentication service
  • This information is stored only in your browser's localStorage — it is never transmitted to or stored on any server operated by DriveSmarter
  • Your Google credentials (password, tokens) are handled entirely by Google and are never accessible to us
  • You can sign out at any time by clicking "Sign out" in the top bar, which removes all stored data
  • We do not use your email for marketing, newsletters, or any communication

The daily usage limit is tracked via a simple counter in your browser's localStorage (date and count only). This resets each day and contains no personal information.

You must not attempt to circumvent the daily usage limit through technical means (clearing storage, using multiple browsers, automation, etc.) without signing in. We reserve the right to modify usage limits at any time.

Intellectual Property

All content on this website — including text, design, code, graphics, and the DriveSmarter name — is the intellectual property of the creators unless otherwise stated. You may use the Tool for personal, non-commercial, educational purposes. You may not reproduce, distribute, or create derivative works from the Tool without written permission.

Third-Party Links & Resources

The Tool may contain links to external websites (e.g., NZTA, energy providers). These links are provided for convenience and informational purposes only. We do not endorse, control, or take responsibility for the content, accuracy, or availability of any third-party website.

Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time without prior notice. Changes take effect immediately upon posting to the website. Your continued use of the Tool after changes constitutes acceptance of the updated terms. The "Last updated" date at the top of this page indicates when these terms were last revised.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from the use of the Tool shall be subject to the exclusive jurisdiction of the courts of New Zealand.
